Protection of Children's Rights in Polygamous Families from the Perspective of the Compilation of Islamic Law

Abstract

This research uses a literature study method, where data is obtained from legal documents through a normative approach. This process involves interpreting the contents of law books as well as documents related to legislation (Statute Approach). After the data is collected, it is analyzed using a qualitative-normative method with a deductive approach, which focuses on child protection in polygamous families from the perspective of Islamic law. In practice, child protection in polygamous families as regulated in the Compilation of Islamic Law (KHI) still requires improvement. Although KHI has addressed this issue, the reality is that many children in polygamous families still experience violence, discrimination and neglect. This challenge in the fulfillment of children's rights in polygamous families demands more substantial efforts to design better child protection mechanisms, so that children can grow and develop optimally.
